The present general conditions of sale apply between: the company ER FRENCHY (also called 100% Frenchy) located at 29 rue Gambetta - 33500 Libourne FRANCE, registered in France at R.C.S. of Libourne under the number 804 370 278, publisher and owner of the site www.https://100pour100frenchy.com/en/, hosted by OVH.
And:
Any person, professional or private individual making a purchase on the site www.https://100pour100frenchy.com/en/, hereinafter referred to as "the Customer".
Preamble
100 % Frenchy advises its customers to inform themselves of the general terms and conditions of sale of the www.https://100pour100frenchy.com/en/.
website. Thus, once the order has been validated, the customer will have tacitly accepted the clauses.
100% Frenchy reserves the right to revise them at any time.
1 - Purpose
The present contract is an online sales contract subject to acceptance by EURL ER FRENCHY and drafted under the terms of current French legislation.
The purpose of this contract is the sale of products presented on the www.https://100pour100frenchy.com/en/.
website. The contract will only be formed between the customer and 100% Frenchy once the customer has received a receipt confirming the order placed on the www.https://100pour100frenchy.com/en/.
website. The customer accepts these terms and conditions of sale without reservation.
Contractual information is provided in the French language, and products offered for sale comply with French legislation as of June 18, 2020.
2 - General terms and conditions of sale
Validation of the order by the customer implies acceptance of the present terms and conditions of sale.
The customer undertakes to pay in full for the products ordered when validating the order.
As the sales contract gives rise to an obligation of means on the part of the seller, 100 % Frenchy undertakes to deliver the items ordered by the customer to the postal services within the timescale announced when the contract was concluded.
100 % Frenchy reserves the right to cancel and reimburse any order from a customer with whom there is a dispute relating to the payment of a previous order, or in the event that 100 % Frenchy is unable to supply the products.
3 - Obligation to provide information
We make every effort to describe and present the products on our website www.https://100pour100frenchy.com/en/ as accurately as possible.
However, 100% Frenchy cannot be held responsible for any errors or omissions in this presentation.
Each product photo has been carefully selected to be as representative as possible. However, the photographs are not contractual and are for information purposes only.
4 - Prices and means of payment
All our product prices are quoted in Euros (€), inclusive of tax (VAT), and exclude shipping and handling costs, which are payable by the customer (except in the case of one-off promotional offers).
They are guaranteed subject to typographical or printing errors. however, 100% Frenchy reserves the right to modify its prices at any time, without prior notice or compensation. In the event of modification, items will be invoiced on the basis of the prices in force at the time the order is registered on the www.https://100pour100frenchy.com/en/ website and subject to availability.
Any discount codes applied do not apply to delivery costs, with the exception of specific free delivery coupons. They cannot be reimbursed. For sales outside the European Union, customs clearance and the payment of various duties and taxes are the responsibility of the customer.
At the time of payment, the total and definitive price indicating the amount inclusive of all taxes (VAT) for the items and delivery will be indicated to the customer.
Transactions carried out on the site are secured by a payment system. Payment is received immediately.

100% Frenchy declines all responsibility in the event of loss of data by Payplug or Paypal, and cannot be held liable for any compensation owed by them.
5 - Delivery
Delivery conditions are valid for metropolitan France, French overseas departments and territories and abroad. Prices are calculated according to the country of shipment, and cover packaging and shipping costs. All orders placed on the www.https://100pour100frenchy.com/en/ website from Tuesday to Friday will be dispatched within 48 hours.

Items are sent in packaging adapted to their fragility. However, 100% Frenchy (the seller) cannot be held responsible for any damaged shipment.
Any return to sender due to an incomplete or incorrect address will be reshipped at the buyer's expense.

- Tracked letter
- Mondial Relay
Delivery times are those usually announced by La Poste.
100% Frenchy also offers a pick-up service at its boutique at 29 rue Gambetta in Libourne. Customers may pick up their order during the day from Tuesday to Saturday, 10am to 1pm and 2.30pm to 7pm, once they have been notified by 100% Frenchy that their order has been validated.
The delivery times of the post office or carriers are indicated for information purposes, but 100% Frenchy cannot be held responsible for delays in delivery or delivery times not respected by the post office or another carrier.
6 - Unavailability of goods ordered
If, exceptionally, the item ordered is no longer available, the purchaser will be reimbursed without delay and at the latest within 14 days of payment of the sums paid.
7 - Right of withdrawal
Although 100% Frenchy strives to offer quality products, it is possible that the customer is not fully satisfied with his/her order and wishes to return it in part or in full.
In accordance with French law, "The consumer (here the Customer) has a period of 14 clear days to exercise his right of retraction without having to justify his reasons or pay any penalty, with the exception, where applicable, of the cost of returning the goods".
The postmark or the date of the delivery receipt constitute the starting date of this retraction period, and its expiry makes any reimbursement impossible.
Damaged, incomplete or deteriorated products will not be exchanged or reimbursed.
100% Frenchy undertakes to issue a refund (excluding return costs) within 14 days, if all the above conditions are met.

9 - Personal data
In order to process orders efficiently, it is necessary to collect customers' personal data.
All such personal information is used exclusively by 100% Frenchy, which undertakes not to divulge it to any third party, with the exception of external service providers who require it for delivery purposes.
This information is included in a confidential file specific to 100% Frenchy.
In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, modify and delete their personal data.
If the customer wishes to exercise this right, he/she simply needs to notify EURL ER FRENCHY by sending an e-mail to the address 100pour100frenchy@gmail.com, indicating his/her surname, first name and address.
10 - Intellectual property rights
All texts, illustrations and images on the www.https://100pour100frenchy.com/en/ website are protected by copyright, trademark law, patent law and image rights, throughout the world.
They are the full and complete property of ER FRENCHY.
Any order placed on the www.https://100pour100frenchy.com/en/ website automatically implies the customer's acceptance of the above terms and conditions of sale, which are governed by French law.
In the event of a dispute, the French courts shall have sole jurisdiction.
